Extension of the simplified remote working arrangement

On the night between July 29 and 30, 2020, the Council of Ministers approved a state of emergency to combat and contain the epidemiological risk posed by COVID-19 until October 15, 2020.


Among the various measures that will be adopted and/or extended as a result is smart working, i.e., the practice of working outside the employer's premises.


Since the Prime Ministerial Decree of February 25, our legislature had allowed, as recommended in subsequent decrees, the adoption of smart working even in the absence of the individual agreements provided for by Law No. 81/2017, with the sole requirement of compliance with health and safety information for the workers involved.


In view of the extension of the state of emergency, companies that have decided to adopt this working method as a measure to prevent and contain the spread of coronavirus (for activities that can be carried out remotely) may continue to adopt the simplified measure even in the absence of individual agreements, following the simplified procedure and the rules that have been in place until now.


Specifically, it will be necessary to notify the Ministry of Labor and Social Policies by entering an Excel template on the dedicated website, which will include the names of the employees concerned and some other essential information, such as the territorial insurance position associated with each employee.
