Extension of the simplified remote work arrangement

On the night of July 29–30, 2020, the Council of Ministers approved a state of emergency to combat and contain the epidemiological risk posed by COVID-19 through October 15, 2020.


Among the various measures that will consequently be adopted and/or extended is remote work, that is, the practice of performing work duties outside the employer’s premises.


Since the Prime Ministerial Decree of February 25, our legislature has permitted—as recommended in subsequent decrees—the adoption of remote work arrangements even in the absence of the individual agreements required by Law No. 81/2017, provided that the relevant health and safety information is provided to the affected employees.


In light of the extension of the state of emergency, companies that have decided to adopt this work arrangement as a measure to prevent and contain the spread of the coronavirus (for activities that can be performed remotely) may continue to use the simplified procedure even in the absence of individual agreements, following the simplified procedure as well as the rules in place to date.


Specifically, this information must be reported to the Ministry of Labor and Social Policies by uploading an Excel template to the dedicated website, which must include the names of the employees concerned and certain other essential details, such as—in particular—the regional insurance classification associated with each employee.
