Subject: Art. 1, paragraph 134, Law No. 234/2021: Permanent Implementation of Mandatory and Voluntary Paternity Leave
The INPS Circular No. 1 of January 3, 2022 addresses paternity leave (mandatory and optional), which Law No. 234/2021 (the so-called Budget Law) has made permanent effective in 2022.
The following is a summary of its key features.
In accordance with existing provisions, for children born, adopted, or placed in foster care on or after January 1, 2022, a father who is an employee is entitled to:
One day of optional leave, which is taken “upon agreement with the mother and in her place, in connection with the period of mandatory leave to which she is entitled.”
A mandatory 10-day leave. This leave may also be taken as a continuous period.
Parental leave—whether mandatory or optional—may be taken within the fifth month following the child’s birth (or the child’s arrival in the family or entry into Italy, in the case of international adoption).
This deadline will also apply in the event of a premature birth.
It should also be noted that paragraph 25 of the Budget Law extends the entitlement to mandatory and optional paternity leave to cases of perinatal death as well.
