Subject: Art. 1 - paragraph 134 - L. n. 234/2021: Stabilization of mandatory and optional paternity leave
The Inps News n. 1 of 03/01/2022 addresses the paternity leave (mandatory and optional) that Law no. 234/2021 (so-called Budget Law) has stabilized starting from 2022.
The essential features are summarized below.
In line with what has already been provided, for children born, adopted or placed in foster care starting from 01/01/2022, the employed father is entitled to:
One day of optional leave, which is used "by agreement with the mother and in her place, in relation to the period of mandatory abstention due to the latter".
Mandatory leave of 10 days. To be enjoyed even continuously.
The leave - both mandatory and optional - can be used within the fifth month following the birth of the child (or entry into the family or entry into Italy of the minor, if the adoption is international).
This term will also apply in the event of premature birth.
It should also be noted that the Budget Law, in paragraph 25, extends the enjoyment of mandatory and optional paternity leave to cases of perinatal death.
