Subject: Art. 1 - paragraph 134 - Law no. 234/2021: Stabilization of mandatory and optional paternity leave
The INPS Circular No. 1 of January 3, 2022 addresses paternity leave (mandatory and optional), which Law no. 234/2021 (the so-called Budget Law) has stabilized with effect from 2022.
The essential features are summarized below.
In line with existing provisions, for children born, adopted, or placed in foster care on or after January 1, 2022, fathers who are employees are entitled to:
An optional day off, which can be taken "by agreement with the mother and in her place, in relation to the period of compulsory leave to which she is entitled."
A mandatory leave of absence lasting 10 days. This leave may also be taken consecutively.
Leave – whether mandatory or optional – can be taken within the fifth month following the birth of the child (or the child's arrival in the family or in Italy, in the case of international adoption).
This term will also apply in the event of premature birth.
It should also be noted that paragraph 25 of the Budget Law extends the entitlement to compulsory and optional paternity leave to cases of perinatal death.
