Subject: Requirement to Submit a Gender Equality Report Extended to Companies with More Than 50 Employees – Submission Must Be Made Online Only
Law No. 162/2021 amended Legislative Decree No. 198/2006 (Equal Opportunity Code) and introduced additional provisions regarding equal opportunity for men and women in the workplace.
The requirement to submit the biennial report on equal opportunity for men and women applies to all companies with more than 50 employees (previously, the threshold applied to companies with more than 100 employees), while still allowing companies with fewer than 50 employees the option, in any case, to submit the biennial report so that they, too, may participate in the certification process, which would allow exemplary companies to access social security contribution benefits and other incentive measures related to calls for proposals for European funds or the awarding of contracts, as already provided for funds allocated to the PNRR (National Recovery and Resilience Plans).
Companies required with more than 50 employees, and companies with up to 50 employees (which may also voluntarily submit the report) that have never filed the biennial equal opportunity report must base their report on the workforce as of December 31, 2019 (with the reference period being 2018–2019).
Companies with more than 100 employees must base their calculations on the number of employees on their payroll as of December 31, 2021 (with the reference period being 2020–2021).
The procedure for completing the form and submitting it to the Ministry of Labor and Social Policies is conducted exclusively online and can only be accessed using SPID or CIE.
The deadline for submitting the prospectus is April 30, 2022.
