Subject: Obligation to submit gender equality reports extended to companies with more than 50 employees – compliance only online
Law No. 162/2021 amended Legislative Decree No. 198/2006 (Equal Opportunities Code) and introduced other provisions on equal opportunities for men and women in the workplace.
The requirement to submit the biennial report on equal opportunities between men and women applies to all companies with more than 50 employees (previously, the threshold was companies with more than 100 employees), while companies with fewer than 50 employees are still entitled, to submit the biennial report in order to participate in the certification process, which would allow virtuous companies to access contribution advantages and other rewards related to calls for tenders for European funds or the awarding of contracts, as already provided for funds granted to PNRR (National Recovery and Resilience Plans).
Companies obliged with more than 50 employees, and companies with up to 50 employees (which may also voluntarily submit the report) that have never submitted the biennial equal opportunities report, must refer to the situation of the workforce as of December 31, 2019 (with the reference period being 2018/2019).
Companies with more than 100 employees must refer to the situation of their workforce as of December 31, 2021 (with a two-year reference period: 2020/2021).
The procedure for completing the form and sending it to the Ministry of Labor and Social Policies is exclusively electronic, and can only be accessed with SPID or CIE.
The deadline for submitting the prospectus is April 30, 2022.
