Lombardy Region Ordinance - Further measures for the prevention and management of the COVID-19 emergency

Subject: Lombardy Region Ordinance no. 546 of 13/05/2020 – Further measures for the prevention and management of the COVID-19 epidemiological emergency.
Attached is Lombardy Region Ordinance no. 546 of 13/05/2020, through which the Region “mandates” compliance with specific provisions regarding the prevention and management of the COVID-19 epidemiological emergency, in order to combat the spread of the virus, prevent contagion risks, and thus protect the health and safety of workers in the workplace through the adoption of measures that ensure adequate safety levels.
The provisions of the aforementioned ordinance take effect from May 18, 2020, and are valid until May 31, 2020, unless the term is extended by a subsequent Ordinance (Art. 2, letter a).
Article 1 of Ordinance no. 546 of 13/05/2020, also available at the following link, stipulates:
Art. 1 (Urgent Measures for Contagion Containment in the Lombardy Region)
Employers shall comply with the following requirements:
a) Personnel must undergo body temperature checks by the employer or their delegate before accessing the workplace. This provision must also be implemented if, during work activities, an employee exhibits symptoms of COVID-19 respiratory infection (e.g., cough, cold, conjunctivitis). If this temperature exceeds 37.5°C, access to or presence in the workplace will not be permitted. Individuals in this condition will be temporarily isolated and must not go to the Emergency Room and/or on-site infirmaries. The employer shall promptly communicate this circumstance, through the competent physician as per Legislative Decree no. 81/2008 and/or the HR department, to the territorially competent ATS (Local Health Authority), which will provide the necessary instructions for the affected individual to follow.
b) It is strongly recommended that temperature checks also be conducted for clients/users before entry. If this temperature exceeds 37.5°C, access to the premises will not be permitted, and the individual concerned will be informed of the need to contact their primary care physician.
