Subject: Lombardy Regional Ordinance No. 546 of May 13, 2020 – Additional measures for the prevention and management of the COVID-19 epidemiological emergency.
Attached is Lombardy Regional Ordinance No. 546 of May 13, 2020, by which the Region “orders” compliance with specific requirements regarding the prevention and management of the COVID-19 epidemiological emergency in order to combat the spread of the virus, prevent the risk of infection, and thereby protect the health and safety of workers in the workplace through the adoption of measures that ensure adequate levels of safety.
The provisions of this ordinance take effect on May 18, 2020, and remain in force until May 31, 2020, unless the deadline is extended by a subsequent ordinance (Art. 2(a))
Article 1 of Ordinance No. 546 of May 13, 2020, which can also be viewed at the following link, provides as follows:
Art. 1 (Urgent measures to contain the spread of infection in the Lombardy Region)
Employers must comply with the following requirements:
a) Before entering the workplace, employees must have their body temperature checked by the employer or the employer’s representative. This requirement must also be enforced if, during work, an employee exhibits symptoms of a COVID-19 respiratory infection (e.g., cough, runny nose, conjunctivitis). If the temperature is above 37.5°C, access to or presence in the workplace will not be permitted. Individuals in this condition will be temporarily isolated and must not go to the Emergency Room and/or the on-site infirmary. The employer shall promptly report this circumstance, through the occupational physician referred to in Legislative Decree No. 81/2008 and/or the personnel office, to the competent local health authority (ATS), which will provide the appropriate instructions that the affected person must follow.
b) We strongly recommend taking the temperature of customers/users as well, prior to entry. If their temperature exceeds 37.5°C, they will not be permitted to enter the premises and will be advised to contact their physician.
