Administrative and Operational Guidelines for an Additional Month of Extended Parental Leave

In News 57 of April 18, 2024, INPS provided administrative and operational instructions regarding the additional month of parental leave paid at 60% of salary (for the year 2024 only, at 80% of salary), a measure introduced by the 2024 Budget Law (Law No. 213/2023), and is valid only for employees who complete their mandatory maternity or paternity leave after December 31, 2023.


Please note that Budget Law No. 213/2023 amended Article 34, paragraph 1, of Legislative Decree No. 151/2001, providing for an increase, from 30% to 60% of salary, for an additional month of parental leave, to be taken within the child’s sixth year of life (or within 6 years of the child joining the family in the case of adoption or foster care, and in any event no later than the adopted or foster child reaching the age of majority).


This provision applies alternately to parents who are employees.

If one parent is self-employed or enrolled in the Separate Pension Scheme, the month of parental leave paid at 60% of salary (note: increased to 80% for the year 2024 only) is available only to the parent who is an employee.

The INPS emphasizes that this is not this is not an “additional” month of parental leave, but rather simply an increase from 30% to 60% (to 80% for 2024 only) of an additional month compared to what was established by the previous year’s Budget Law, No. 197/2022, while the total three months of parental leave to which each parent is entitled and which cannot be transferred to the other parent. The additional month at 60% (80% for 2024 only) is only one for both parents and may be taken in full, broken down into days, or on an hourly basis, and the month may be divided between the parents or taken by only one of them.

The INPS clarifies that the “alternating” use of parental leave by parents, as provided for in the amended Article 34 of Legislative Decree No. 151/2001, does not preclude the possibility of taking leave on the same days and for the same child, as is permitted for all periods of parental leave.
