Administrative and operational instructions for an additional month of enhanced parental leave

INPS, with News no. 57 of April 18, 2024, has provided administrative and operational instructions regarding the additional month of parental leave paid at 60% of remuneration (for the year 2024 only, at 80% of remuneration), a measure introduced by the 2024 Budget Law (Law no. 213/2023), and valid only for employees who conclude their mandatory maternity or paternity leave after December 31, 2023.
We recall that Budget Law no. 213/2023 amended Article 34, paragraph 1 of Legislative Decree no. 151/2001, providing for an increase, from 30% to 60% of remuneration, for the parental leave allowance for an additional month, to be taken within the child's sixth year of life (or within 6 years from the child's entry into the family in cases of adoption or foster care and, in any case, not beyond the age of majority of the adopted or fostered child).
This provision applies alternatively between employed parents.
If one parent is a self-employed worker or registered with the Separate Management Scheme, the month of parental leave indemnified at 60% of remuneration (which, we remind, is increased to 80% for the sole and exclusive year 2024) is due only to the employed parent.
INPS emphasizes that it is not an 'additional' month of parental leave, but rather solely the increase from 30% to 60% (for 2024 only, to 80%) of an existing additional month compared to what was established by the previous year's Budget Law, no. 197/2022, while the total of three months of parental leave due to each parent and not transferable to the other parent remains unchanged. The additional month at 60% (for 2024 only, at 80%) is only one for both parents and can be taken in full, split into days, or on an hourly basis, and the month can be shared between the parents or taken by only one of them.
INPS clarifies that the 'alternating' use between parents, as provided for by the amended Article 34 of Legislative Decree no. 151/2001, does not preclude the possibility of taking it on the same days and for the same child, as is permitted for all parental leave periods.
