Subject: Ministry of Labor News No. 9/2023 containing “initial guidance” on the amendments made to fixed-term contracts by Law Decree No. 48/2023.
As known, Article 24 of Law Decree 48/2023 (the so-called Labor Decree, converted with amendments by Law No. 85/2023) has modified the regulations on fixed-term employment contracts.
After some months, the Ministry of Labor has issued the awaited explanatory News (No. 9 of 09/10/2023) concerning the new provisions on fixed-term contracts.
It should be noted, as stated in the subject, that these are “initial guidance.”
It is worth remembering that the News issued by the Ministry does not have the force of law but guides the activity of Labor Inspectors.
The text shared by the Ministry makes several references to the legislation governing fixed-term contracts, considering it necessary to use this approach to explain the methods of recourse to causal reasons or the possible exclusion from the obligation to do so.
