Subject: Ministry of Labor Circular No. 9/2023 ( News ) containing “initial guidelines” on the changes made to fixed-term contracts by Decree-Law No. 48/2023.


As is well known, Article 24 of Decree-Law 48/2023 (the so-called “Labor Decree,” converted with amendments by Law No. 85/2023) amended the regulations governing fixed-term employment contracts.

A few months later, the Ministry of Labor issued the long-awaited explanatory circular (No. 9, dated October 9, 2023) regarding the new provisions on fixed-term contracts.

Please note, as stated in the subject line, that these are “preliminary indications.”


It is worth noting that the circular issued by the Ministry does not have the force of law, but serves as a guideline for labor inspectors.

The text shared by the Ministry includes a number of references to the legislation governing fixed-term contracts, as it deems it necessary to use this approach to explain how to cite grounds for such contracts or the possible exemption from the requirement to provide them.
