Subject: News of Labor News No. 9/2023 containing “initial guidelines” on the changes made to fixed-term contracts by Decree-Law No. 48/2023.
As is well known, Article 24 of Decree-Law No. 48/2023 (the so-called “Labor Decree,” converted with amendments by Law No. 85/2023) amended the regulations governing fixed-term employment contracts.
A few months later, the Ministry of Labor issued the long-awaited explanatory circular (No. 9 of October 9, 2023) regarding the new provisions on fixed-term contracts.
Please note, as mentioned in the subject line, that these are “preliminary indications.”
It is worth noting that the circular issued by the Ministry does not have the force of law, but serves as a guideline for labor inspectors.
The text released by the Ministry contains a number of references to the legislation governing fixed-term contracts, as it deems it necessary to do so in order to explain how to invoke grounds for termination or any exemptions from the requirement to provide such grounds.
