I construction sites are among the most dangerous workplaces, where serious, sometimes fatal, accidents occur every year. To increase the safety of workers and all professionals involved in construction sites, the government has issued a Decree (DL 19/2024) establishing the entry into force on October 1, 2024, of a number of new obligations to strengthen worker safety: these include a points-based license on construction sites. Specifically, Article 27 of Legislative Decree No. 81/2008 has been replaced by the following:
“(System for qualifying companies and self-employed workers through credits). - 1. As of October 1, 2024, and following the integration of the portal referred to in paragraph 9, companies and self-employed workers operating on temporary or mobile construction sites referred to in Article 89, paragraph 1, letter a) are required to hold the license referred to in this article. The license is issued in digital format by the competent territorial office of the National Labor Inspectorate, subject to the legal representative of the company or the self-employed worker applying for it meeting the following requirements: a) registration with the Chamber of Commerce, Industry, and Crafts;
b) fulfillment, by the employer, managers, supervisors, and workers of the company, of the training obligations referred to in Article 37;
c) fulfillment, by self-employed workers, of the training obligations set forth in this decree;
d) possession of a valid single document certifying contribution regularity (DURC);
e) possession of the Risk Assessment Document (DVR);
f) possession of the Single Document of Fiscal Regularity (DURF).
Ministerial Decree No. 132 of September 18, 2024 defined the procedures for applying for the credit license required to operate within temporary and mobile construction sites. The credit license will come into effect on October 1, 2024.
