Credit-Based Safety License and Procedures for

The construction sites are among the most dangerous work environments, where serious—and sometimes fatal—accidents occur every year. To improve safety for workers and all professionals involved in construction sites, the government has issued a Decree (DL 19/2024) establishing that, effective October 1, 2024, certain new requirements will take effect to strengthen worker safety: among these is the point-based license system for construction sites. Specifically, Article 27 of Legislative Decree No. 81/2008 has been replaced by the following:
“(A system for certifying businesses and self-employed individuals through credits). - 1. Effective October 1, 2024, and upon completion of the integration of the portal referred to in paragraph 9, companies and self-employed individuals operating at temporary or mobile construction sites as defined in Article 89, paragraph 1, letter a) are required to hold the license referred to in this article. The license is issued in digital format by the competent regional office of the National Labor Inspectorate, provided that the legal representative of the company or the self-employed individual making the request meets the following requirements: a) registration with the Chamber of Commerce, Industry, and Crafts;
(b) compliance by the employer, managers, supervisors, and employees of the company with the training requirements set forth in Article 37;
(c) compliance by self-employed workers with the training requirements set forth in this decree;
d) possession of a valid Single Certificate of Social Security Compliance (DURC);
e) possession of the Risk Assessment Document (DVR);
f) possession of the Single Tax Compliance Certificate (DURF).”
Ministerial Decree No. 132 of September 18, 2024, established the procedures for applying for the credit-based license, which is required to work on temporary and mobile construction sites. The credit-based license will take effect on October 1, 2024.
