Urgent Measures for the Containment and Management of the COVID-19 Public Health Emergency

Following the Decree-Law containing urgent measures regarding the containment and management of the COVID-19 epidemiological emergency and its implementing provisions—aimed at containing and managing the epidemiological emergency—the following are the main measures adopted to address the situation from the perspective of employment and related tax obligations.


To begin with, the municipalities affected by the urgent measures to contain the spread of the virus are:

  • in the Lombardy Region: Bertonico; Casalpusterlengo; Castelgerundo; Castiglione D’Adda; Codogno; Fombio; Maleo; San Fiorano; Somaglia; Terranova dei Passerini.

  • in the Veneto Region: Vò.


These measures take effect immediately and remain in force until Sunday, March 8, 2020, subject to any subsequent provisions.


MEASURES TAKEN

Work arrangements: remote work

For municipalities affected by the emergency measures, the so-called "smart working" arrangement is automatically applied to all employment relationships that do not require physical presence at the workplace, even in the absence of the required individual agreements.


For all other municipalities, a contract must be signed in accordance with the relevant regulations. Specifically, an agreement must be signed between the employer and the employee, which must then be registered and uploaded to the Ministry of Labor’s website (Cliclavoro).


Workplace Safety

Under the provisions of Article 2087 of the Civil Code, employers are required to take measures to protect the physical well-being of their employees; therefore, it is necessary to review the procedures and measures related to worker health and safety.
