Urgent measures for the containment and management of the COVID-19 epidemiological emergency

Following the Decree-Law containing urgent measures for the containment and management of the COVID-19 epidemiological emergency and the provisions implementing it - aimed at containing and managing the epidemiological emergency - the main measures adopted to deal with the situation from an employment perspective and the related tax obligations are reported below.


Firstly, it should be noted that the municipalities affected by the urgent measures to contain the spread of infection are:

  • in the Lombardy Region: Bertonico; Casalpusterlengo; Castelgerundo; Castiglione D’Adda; Codogno; Fombio; Maleo; San Fiorano; Somaglia; Terranova dei Passerini.

  • in the Veneto Region: Vò.


These measures are effective immediately until Sunday, March 8, 2020, unless further provisions are issued.


MEASURES TAKEN

Working arrangements: flexible working

For municipalities affected by the urgent measures, agile working, known as smart working, is automatically applied to all employment relationships that do not require the employee to be physically present at the company, even in the absence of the required individual agreements.


For all other municipalities, it will be necessary to sign a contract as required by the relevant legislation. Specifically, it will be necessary to sign an agreement between the employer and the employee, which must be registered and uploaded to the Ministry of Labor website (Cliclavoro).


Protection in the workplace

According to Article 2087 of the Civil Code, employers are required to take measures to protect the physical integrity of their employees. Therefore, it is necessary to analyze the procedures and measures relating to the health and safety of workers.
