Subject: Increase in parental leave benefits from 30% to 80% of pay for a maximum period of one month and new event codes


In a recent circular, INPS issued operational guidelines for increasing the parental leave allowance from 30% to 80% of salary for a maximum period of one month and up to the child’s sixth birthday, a measure introduced by Law No. 197 of December 29, 2023 (2023 Budget Law) in Article 1, paragraph 359.

The increase in the allowance applies exclusively to employees, and therefore excludes all other categories of workers.


Consequently, if one parent is an employee and the other is not, only the parent who is an employee is entitled to the month of parental leave paid at 80% of their salary.


No additional month is added to the total number of months of parental leave: rather, there is only an increase in the allowance for one of the three months to which each parent is entitled, which cannot be transferred to the other parent, provided that the monthly allowance, equal to 80% of the parent’s salary, is taken within the first six years of the child’s life (or within six years of the child joining the family, in the case of adoption or foster care).


The INPS notes that the month for which 80% of wages is paid is limited to one month for both parents, and this benefit may be shared between them or claimed by only one of them.
