Conversion of the Milleproroghe Decree into law - Decree-Law No. 183/2020; Law No. 21/2021

This document outlines the main changes in labor law introduced when the Milleproroghe Decree was converted into law, which took effect on March 2, 2021.


Suspension of the statute of limitations on social security and welfare contributions (Art. 11, para. 9)

The statute of limitations for mandatory social security and welfare contributions (pursuant to Article 3, paragraph 9, of Law No. 335/1995) is suspended for the period from December 31, 2020, through June 30, 2021. The resumption of the aforementioned periods will take effect from the end of the suspension period. If such periods begin to run during that period, the limitation periods will commence on July 1, 2021.


COVID-19 Layoff Benefits: 2020 Amnesty (Section 11, Paragraph 10-bis)

The deadlines for submitting applications for access to COVID-19 wage supplementation benefits, along with the deadlines for submitting data for payment or settlement of such benefits (Form SR-41), which were originally set to expire by December 31, 2020, have been extended to March 31, 2021. Therefore, companies that submitted their applications or employee data late may still be eligible for wage supplementation—provided they submit the required information by March 31, 2021—without incurring any penalties. Any applications and Form SR-41 relating to weeks of wage supplementation in December 2020, for which the deadlines expired by January 31, 2021, are not covered by the amnesty provided for in the Milleproroghe Decree.
