Law No. 203 of December 13, 2024, containing “Provisions on Labor Matters”(the so-called “Collegato Lavoro”), was published in the Gazzetta Ufficiale on December 28, 2024, and will come into force on January 12, 2025.
The measure aims to simplify and correct various obligations related to the employment relationship, with particular reference to the regulations on health and safety in the workplace, regulations on social safety nets, and regulations on employment contracts.
With Note No. 9740 of December 30, 2024, the National Labour Inspectorate provided initial guidance on the contents of the Law.
With this News, we summarize the most relevant changes for private employers.
“Amendments to Legislative Decree No. 81 of April 09, 2008” – Regulations on health and safety in the workplace (art. 1)
a) The Ministry is required to prepare an annual report
of Labour to be submitted to the Chambers on the state of safety in the workplace, which must include an indication of the measures to improve safety conditions.
b) As part of the health surveillance carried out by the company doctor,
the possibility of carrying out preventive medical examinations to assess fitness for the specific task in the pre-employment phase is recognized.
c) Following absences exceeding 60 consecutive days, the company
doctor is responsible for assessing the opportunity to carry out medical examinations prior to the date of return to work.
