a) Updates on Agile Working


Law No. 52 of May 19, 2022, converting Decree Law No. 24 of March 24, 2022, on reopening, introduced the following changes regarding agile working:


The terms provided for in the legislative provisions referred to in Article 90, paragraphs 1 and 2, of Decree Law No. 34 of May 19, 2020, converted, with amendments, by Law No. 77 of July 17, 2020, relating to agile working for workers in the private sector, are extended to July 31, 2022.


This means that parents who are employees in the private sector and have at least one child under the age of 14, provided that there is no other parent in the household who is receiving income support in the event of suspension or termination of employment, or that there is no non-working parent, are entitled to work remotely, even in the absence of individual agreements, without prejudice to compliance with the information obligations that are fulfilled electronically, including by using the documentation made available on the INAIL website.


In paragraph 2 of Article 10 of the Decree Law on Reopening, paragraph 2-bis has been added, according to which the provisions of Article 90, paragraphs 3 and 4, of Decree Law No. 34 of May 19, 2020, continue to apply until August 31, 2022.
