a) Updates on Remote Work


Law No. 52 of May 19, 2022, converting Decree-Law No. 24 of March 24, 2022, known as the “Reopening” Decree-Law, introduced the following changes regarding remote work:


The deadlines set forth in the legislative provisions referred to in Article 90, paragraphs 1 and 2, of Decree-Law No. 34 of May 19, 2020, converted, with amendments, by Law No. 77 of July 17, 2020, regarding remote work for private-sector employees, are extended to July 31, 2022.


This means that parents who are employees in the private sector and have at least one child under the age of 14, provided that there is no other parent in the household receiving income support in the event of suspension or termination of employment, or that there is no non-working parent, are entitled to work remotely, even in the absence of individual agreements, provided that they comply with the reporting requirements, which may be fulfilled electronically using the documentation available on the INAIL website.


Paragraph 2-bis has been added to paragraph 2 of Article 10 of the Decree-Law on Reopenings, providing that the provisions set forth in Article 90, paragraphs 3 and 4, of Decree-Law No. 34 of May 19, 2020, shall continue to apply until August 31, 2022.
