Adoption of Smart Working: New Communication Procedures

With the conversion into Law of Law Decree No. 73/2022 (the so-called Simplification Decree), significant changes have been introduced regarding the communication procedures for services rendered in smart working.


Specifically, the new Article 41-bis introduces amendments to Article 23 of Law No. 81/2017.

More specifically, following these amendments, the new paragraph 1 of Article 23 stipulates that, effective September 1, 2022, employers must electronically communicate to the Ministry of Labor the names of employees and the start and end dates of agile work arrangements, in accordance with the procedures defined by a decree from the Minister of Labor and Social Policies.


On August 22nd, the competent Ministry issued Ministerial Decree No. 149/2022, which defines the new electronic communication procedures for agile work.

The same data pertaining to agile work performance will be made available to the National Institute for Insurance against Accidents at Work, following the procedures outlined in the Digital Administration Code.
