Adoption of remote work: new communication methods

With the conversion of Decree-Law No. 73/2022 (the so-called “Simplification Decree”) into law, significant changes have been made to the procedures for reporting work performed remotely.


Specifically, the new Article 41-bis amends Article 23 of Law No. 81 of 2017.

Specifically, following these amendments, the new paragraph 1 of Article 23 provides that, effective September 1, 2022, employers must electronically report to the Ministry of Labor the names of employees and the start and end dates of their remote work, in accordance with the procedures established by decree of the Minister of Labor and Social Policies.


On August 22, the relevant ministry issued Ministerial Decree No. 149/2022, which establishes new procedures for reporting remote work, to be carried out electronically.

The same data regarding remote work will be made available to the National Institute for Insurance against Accidents at Work in accordance with the procedures set forth in the Digital Administration Code.
