Adopting smart working: new ways of communicating

With the conversion of Decree Law No. 73/2022 (the so-called Simplification Decree) into law, important changes have been made to the procedures for communicating work performed remotely.


In particular, the new Article 41-bis amends Article 23 of Law 81/2017.

Specifically, following these changes, the new paragraph 1 of Article 23 stipulates that, starting from September 1, 2022, employers must electronically communicate to the Ministry of Labor the names of workers and the start and end dates of agile working arrangements, in accordance with the procedures identified by decree of the Minister of Labor and Social Policies.


On August 22, the competent Ministry issued Ministerial Decree No. 149/2022, which identifies the new methods for communicating agile working arrangements electronically.

The same data relating to agile working arrangements will be made available to the National Institute for Insurance against Accidents at Work in accordance with the procedures set out in the Digital Administration Code.
