Smart working adoption: new communication methods

With the conversion into law of Decree Law no. 73/2022 (the so-called Simplifications Decree), important changes have been made to the methods of communicating services provided via smart working.


Specifically, the new Article 41-bis introduces changes to Article 23 of Law 81/2017.

Specifically, as a result of these changes, the new paragraph 1 of Article 23 stipulates that, starting from September 1, 2022, the employer must electronically communicate the names of the workers and the start and end dates of the work performed in agile mode to the Ministry of Labor, according to the procedures identified by decree of the Minister of Labor and Social Policies.


On August 22, the competent Ministry issued Ministerial Decree No. 149/2022, which identifies the new procedures for communicating agile work electronically.

The same data relating to work performed in agile mode will be made available to the National Institute for Insurance against Accidents at Work in the manner provided for by the Digital Administration Code.
