News . 38/2022

In light of the general election on September 25, 2022, we believe it is appropriate to summarize the obligations of employees and employers.

Employees may be appointed to polling places in the following capacities:

  • Polling station chairperson

  • Secretary

  • Election official

  • List Representative

Workers involved in election-related activities are entitled to take time off work for the entire duration of voting and ballot counting.

Days of absence will be considered days of work.

Under no circumstances may an employer prevent an employee from performing this duty.

For employees, voting at the polling place is subject to the following rules:

  • 1) Days considered workdays (Mondays, or Saturdays if deemed workdays under the applicable national collective bargaining agreement) must be paid at the regular rate, as if the employee had performed their usual work at the company;

  • 2) Public holidays or non-working days (usually Sundays, but also Saturdays in the case of a short workweek) entitle the employee to additional pay on top of their regular pay, or to one or two days of compensatory time off.
