Electoral Leave Management

News n.38/2022


In anticipation of the general elections on September 25, 2022, we deem it appropriate to summarize the obligations for both employees and companies.


Salaried employees may be appointed to polling stations in the following capacities:

  • Presiding Officer

  • Secretary

  • Scrutineer

  • Party Representative


Employees involved in electoral activities are entitled to be absent from work for the entire period corresponding to the duration of voting and counting operations.

The days of absence will be considered as working days.

Under no circumstances may the employer prevent their employee from fulfilling this duty.


Participation in polling station duties for subordinate employees entails the application of the following regime:

  • 1) Days considered working days (Monday, or Saturday if deemed a working day by the applicable National Collective Bargaining Agreement - CCNL) must be remunerated with ordinary pay, as if the employee had performed their usual work activities at the company;

  • 2) Public holidays or non-working days (typically Sunday, but also Saturday in the case of a short week) entitle the employee to an additional remuneration component beyond ordinary pay, or to one or two days of compensatory leave.
