In view of the general election on September 25, 2022, we believe it is appropriate to summarize the obligations of workers and companies.
Employees may be appointed to polling stations in the following capacities:
Polling station president
Secretary
Scrutineer
List Representative
Workers involved in electoral activities have the right to take leave from work for the entire period corresponding to the duration of voting and ballot counting operations.
The days of absence will be considered days of work.
The employer may not, under any circumstances, prevent their employee from performing this task.
Participation in the polling station requires the application of the following rules for employees:
1) Days considered working days (Mondays, or Saturdays if considered working days by the applicable national collective labor agreement) must be paid at the normal rate, as if the worker had performed their usual work at the company;
2) Public holidays or non-working days (usually Sundays, but also Saturdays in the case of a short week) entitle employees to additional pay on top of their normal salary, or one or two days of compensatory rest.
