Management of electoral leave

News No. 38/2022


Regarding the political elections of September 25, 2022, we deem it appropriate to summarise the obligations of employees and companies.


Employees may be appointed to polling stations in the capacity of:

  • President of the polling station

  • Secretary

  • Scrutineer

  • Party Representative


Workers engaged in electoral activities have the right to be absent from work for the entire period corresponding to the duration of the voting and counting operations.

The days of absence will be considered as days of work activity.

The employer may not, under any circumstances, prevent their employee from fulfilling this task.


Participation in the polling station provides for the application of the following regime for subordinate workers:

  • 1) Days considered working days (Monday, or Saturday if considered a working day by the applicable Collective Bargaining Agreement) must be paid with ordinary remuneration, as if the worker had performed their usual work activity at the company;

  • 2) Holidays or non-working days (usually Sunday, but also Saturday in the case of a short week) entitle employees to an additional portion of salary compared to the ordinary salary, or one or two days of compensatory rest.
