D.L. n. 48/2023: Urgent measures for social inclusion and access to the world of work

On May 4, the so-called Labor Decree (D.L. n. 48/2023) was published in the Official Gazette n. 103.
The decree came into force on May 5, 2023.
As expected, the measure is quite complex, having introduced a series of changes to existing measures as well as new provisions.
Given the substantial nature of the published text, and pending the desired clarifications on the measures introduced, a summary of some of the points of greatest interest to employers is provided below.
Safety (articles 14 -18):
D.L. n. 48/2023 in Chapter II intervenes on the subject of safety in the workplace, making changes to Legislative Decree 9 April 2008, n. 81.
In particular, the extension of the protection measures provided for in construction sites is ordered also for self-employed workers, the obligation to update the DVR in the event of the activation of school-work alternation paths with the identification of those responsible for the internship path. Furthermore, a Fund is established to support the families of students who are victims of work.
An amendment is made to art. 25 paragraph 1 of Legislative Decree n. 81/2008. Letter e) provides that the competent doctor “delivers to the worker, upon termination of the employment relationship, the health documentation in his possession (...) and provides him with information regarding the need for conservation”. With the Decree in question, letter e-bis) is added, which provides that the competent doctor requests the worker, during pre-employment medical examinations, for the health record issued by the previous employer and takes into account its content for the purposes of formulating the judgment of suitability.
