Decree Law No. 48/2023: Urgent measures for social inclusion and access to the labor market

The decree came into force on May 5, 2023.
As expected, the measure is quite complex, having introduced a series of amendments to existing measures as well as new provisions.
Given the length of the published text, and pending the hoped-for clarifications on the measures introduced, below is a summary of some of the points of greatest interest to employers.
Safety (Articles 14-18):
Decree Law No. 48/2023, Chapter II, addresses workplace safety, amending Legislative Decree No. 81 of April 9, 2008.
In particular, the protective measures provided for on construction sites are extended to self-employed workers, and there is an obligation to update the DVR (Risk Assessment Document) in the event of school/work alternation programs being activated, with the identification of those responsible for the internship program. A fund has also been set up to support the families of students who are victims of labor exploitation.
An amendment is made to Article 25, paragraph 1, of Legislative Decree No. 81/2008. Letter e) provides that the competent doctor "shall, upon termination of employment, provide the worker with the health documentation in his possession (...) and shall provide him with information regarding the need for storage". The Decree in question adds letter e-bis), which stipulates that the competent doctor shall request the health records issued by the previous employer from the worker during the pre-employment medical examination and shall take their content into account when formulating their assessment of fitness for work.
