The “Decree of the Minister of Labor and Social Policies, in consultation with the Minister of Economy and Finance, dated May 21, 2024,” was published in Gazzetta No. 159 of July 9, 2024, and provides for the adjustment of the Bilateral Solidarity Fund for Professional Activities.
The Interministerial Decree of May 21, 2024, implements the provisions of the collective agreement signed on December 27, 2022, between Confprofessioni, Filcams CGIL, Fisascat CISL, and Uil-tucs, and aligns the regulations governing the Bilateral Solidarity Fund for Professional Activities (established by the decree of the Minister of Labor and Social Policies) with the regulations on social safety nets during the employment relationship set forth in Law No. 234 of December 30, 2021, as amended.
The regulatory provisions contained therein have been fully in effect since 9 July 2024.
With regard to the new regulations governing the Fund, please note the following.
Article 2 of the Ministerial Decree of May 21, 2024, redefined the scope of the Fund, which now extends to employers in the professional services sector who employ at least one employee, whereas previously the size requirement applied to employers with more than 3 employees.
Article 5 of the same interministerial decree expanded the scope of workers eligible for the protections guaranteed by the Fund, including workers hired under any type of apprenticeship contract, and explicitly confirming the exclusion of executives.
